1. Agreement to our Legal Terms and Outline of App Functionalities

These legal terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (‘you”), and Dusty Foot Tours & Travels CC, Namibia, concerning your access to and use of the services of the mobile application, Pocket Guide Namibia. You agree to, that by accessing the application and its services, you have read, understood and agree to be bound by all of the legal terms set out in this agreement.

Pocket Guide Namibia is a mobile application designed to display information. By using the services, you acknowledge the following:

·         The application is not meant to be a navigational tool in the sense of providing driving directions. The map however does contain relevant road numbers and demarcations. It therefore is advisable to use the application in tandem with an ad-hoc navigational tool or regular map.

2. Use License

Welcome to Pocket Guide Namibia! This mobile application is provided to you by Dusty Foot Tours & Travels CC, Namibia. By downloading, installing, or using Pocket Guide Namibia, you agree to be bound by the following terms of use. If you do not agree to these terms, you should not use Pocket Guide Namibia.

Subject to your compliance with these terms of use, Dusty Foot Tours & Travels CC grants you a limited, non-exclusive, non-transferable, revocable license to access and use Pocket Guide Namibia for your personal, non-commercial use. This license does not include the right to:

• copy, modify, or distribute Pocket Guide Namibia or any content therein outside of the sharing system provided in the App;

• use Pocket Guide Namibia for any commercial purpose or for the benefit of any third party;

• download, extract, or scrape any data from Pocket Guide Namibia or any content therein;

• use any automated means to access or use Pocket Guide Namibia or any content therein;

• frame or otherwise display Pocket Guide Namibia or any content therein;

• use any meta tags or other hidden text using Dusty Foot Tours and Travels CC's name or trademarks; or

• reverse engineer, decompile, or disassemble any aspect of Pocket Guide Namibia or any content therein.

You agree to use Pocket Guide Namibia only for lawful purposes and in compliance with all applicable laws and regulations. You further agree not to use Pocket Guide Namibia in any manner that could disable, overburden, or impair the site or interfere with any other users or third party's use and enjoyment of Pocket Guide Namibia.

We may, in our sole discretion, terminate or suspend your access to Pocket Guide Namibia if we believe that you have violated any provision of these terms of use or any applicable law or regulation.

All rights not expressly granted to you in these terms of use are reserved and retained by Dusty Foot Tours & Travels CC.

3. Use of Pocket Guide Namibia

Pocket Guide Namibia is a mobile application designed to provide users with travel information and guide like services for Namibia. You may use Pocket Guide Namibia only for lawful purposes and in accordance with these terms of use. You may not use Pocket Guide Namibia:

• In any way that violates any applicable regional, local, or international law or regulation.

• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.

• To impersonate or attempt to impersonate Dusty Foot Tours & Travels CC & Pocket Guide Namibia, a Dusty Foot Tours & Travels CC or Pocket Guide Namibia employee, another user, or any other person or entity (including, without limitation, by using email addresses or screen names associated with any of the foregoing).

• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of Pocket Guide Namibia, or which, as determined by Dusty Foot Tours and Travels CC, may harm itself or users of Pocket Guide Namibia, or expose them to liability.

4. User Accounts, Security & Privacy Policy

Once you have purchased the application, no personal information is required to access or utilize the full map functionality. You can, at your own discretion, create a profile but it is not required. If you do chose to create a profile requiring the inputting of information like, but not limited to; name, date of birth, email address, telephone number, financial information. This profile and issues relating to its security and your personal data will be governed by the following section.

Protecting your personal information and privacy is important to us. We have implemented measures to help safeguard your information from unauthorized access and disclosure and hereby declare, we will NOT share or divulge any private information internally or to any third parties. We do however need to stress to you, that no databases, methods of electronic communication, data transfer connections are free of flaws, we do everything we can to ensure the safety and security of your data, but cannot guarantee with no uncertainty the integrity. If, in the unlikely event a data breach does occur, Pocket Guide Namibia will inform all of its user of such an event.

You are responsible for maintaining the confidentiality of your account information, including your username and password, and for restricting access to your mobile device. You agree to accept responsibility for all activities that occur under your account. In addition, you agree to immediately notify us of any unauthorized access to or use of your account or any other breach of security. You also acknowledge that any information inputted in to the application is correct and up to date.

We may, in our sole discretion, terminate or suspend your access to Pocket Guide Namibia if we believe that you have violated any provision of these terms of use or any applicable law or regulation, or if we believe that your account has been compromised.

Dusty Foot Tours & Travels CC does not warrant that Pocket Guide Namibia will be uninterrupted or error-free, or that any defects will be corrected. Dusty Foot Tours & Travels CC does not make any representations or warranties regarding the use or results of Pocket Guide Namibia in terms of its correctness, accuracy, reliability, or otherwise. You assume all responsibility and risk for your use of the application or any features in it.

You also accept that Pocket Guide Namibia and Dusty Foot Tours and Travels CC, will not be held responsible for the quality of your experience in places the app lists.

Dusty Foot Tours & Travels and Pocket Guide Namibia, will carry no liability expressly mentioned or otherwise in the event of:

·         Any personal injury/death, loss or damage to property while partaking in any listed activity

·         Any personal injury/death, loss or damage to property while exploring or visiting any listed sight of interest, or any other listing in the app.

Any personal injury/death, loss or damage to property, while applying any of the first aid information given in that relevant section in the APP. You also hereby acknowledge that the information provided in the First Aid section is no replacement for proper medical training or the assistance of professionals. We always advise you always aim to seek professional help in the case of an extreme medical emergency.
